Information Ordering:
All
orders submitted to RB Kinetic Toys Inc. must be placed by authorized personnel.
It is the responsibility of the customer to ensure that only an authorized person
places an order. RB Kinetic Toys Inc. will not be held responsible or liable for
orders placed by anyone representing or employed by the customer that is not authorized
to execute a purchase transaction.
Billing:
For customers without established
credit, a 50% deposit of the total cost of the project is required before production
begins. Sales and use tax, if any, will be paid by the customer.
Shipping:
All orders are shipped F.O.B. New
York City. We most often use United Parcel Service or Federal Express. However,
since we provide custom service at every stage of a project we will try to accommodate
special shipping needs.
Claims:
Upon receipt
of your order, examine all merchandise. Claims for shortage or defective goods
must be reported to us within five days of receipt of merchandise. Claims for
an undelivered shipment must be reported to us within five days of anticipated
receipt of merchandise.
Cancellation Charges:
Orders canceled during
production will be charged an amount equal to the percentage of completion of
the order at the time of cancellation. Promotional
Rights:
RB Kinetic Toys Inc. reserves the right to use any and
all products produced for sale to customers in any advertising, marketing and
display vehicles unless otherwise specified in writing by the customer at the
time the order is placed. Products displayed in any advertising, marketing and
display vehicles are shown as examples of the type and quality of our work. They
are not for sale, nor are they to be construed as product or brand-name endorsements
for the registered mark owner.
Trade Marks, Copyrights and Registration Marks:
The customer shall defend, hold harmless and free of all liability, RB Kinetic
Toys Inc. regarding trademark, registration marks, or copyright infringement and/or
disputes. RB Kinetic Toys Inc. assumes the customer has permission prior to production
to use all registered designs, marks, logos graphics, and other art work submitted
for the express purpose of reproduction of same into custom awards and gifts.The
customer agrees to assume any and all responsibility and liability resulting from
trade mark, registration mark, or copyright infringement actions or demands brought
